Updated Mining Acts and regulations to commence 1 January 2021.
The new mining regulations, under the Statutes Amendment (Mineral Resources) Act 2019, were gazetted 19 November 2020.
Minister for Energy and Mining, Dan van Holst Pellekaan, announcing the release of the Mining Regulations 2020 said it, ‘is the final step of the South Australian Mining Act review.’
‘The new Mining Act and Regulations are the culmination of a significant review to provide a more robust and modern Mining Act for South Australia.’
The new regulations set out in more detail how the processes in the amended Mining Act will operate and how they will be applied. A key process in finalising these was consultation with the South Australian public to ensure that issues resulting from changes to the revised Mining Act are clear and outline the future direction for the sector. Fifty-eight submissions were received from a wide variety of stakeholders.
‘The enactment of this new mining legislation delivers important reform for the South Australian resources industry and forms an important step in improvements for this important sector,’ Minister van Holst Pellekaan said.
Moving forward, the Department for Energy and Mining will work with industry and stakeholders on further non-regulatory matters in 2021 during the transition to the new regulatory arrangements.
The department thanks all stakeholders who have been involved in this process for their considered and valued feedback.
