Application

Adelaide Brighton Cement Limited (ABC), the operator of the Klein Point Quarry, has acquired land to the southwest of the quarry (CT 5833/574, Section 4 in the Hundred of Dalrymple). A portion of ABC’s acquired land (approximately 3.7 ha) falls within the SA Coastal Reserve (refer to below map).

ABC has requested that the portion of the Coastal Reserve within Section 4 in the Hundred of Dalrymple be lifted, to enable ABC to apply for mining tenure.

A Coastal Reserve

At the commencement of the of the Mining Act 1971 (the Mining Act) to make land available for exploration and mining, all land within South Australia was proclaimed as mineral land. The Mining Act applies to mineral land, enabling the grant of exploration and mining tenure, and the administration and regulation of this tenure.

In 1973, the SA Coastal Reserve Proclamation (Proclamation) was gazetted to reserve land, within an area 800m inland from the high-water mark, from the Mining Act.  This area is referred to as the SA Coastal Reserve (Coastal Reserve) and exploration and mining is not permitted in this area.

A mining lease (nor any other form of tenure under the Mining Act) cannot be established within 800m of the high-water mark without the relevant section of the Coastal Reserve being lifted by proclamation of the Governor. If the Coastal Reserve is lifted, this land will return to being mineral land and applications for tenure can be made under the Mining Act.

The Department for Energy and Mining invites members of the public to make written submissions in relation to ABC’s proposal to lift the coastal reserve at Klein Point.

Please note that this consultation relates only to the proposal to lift a portion of the Coastal Reserve, which will enable ABC to submit applications for tenure under the Mining Act. If ABC make application for a mining lease, a separate statutory consultation process will be undertaken during the assessment of an application, and the public will be provided with an opportunity to provide comment on the application at that time.

Next Steps

DEM will consider any responses as part of its assessment of the request to lift the Coastal Reserve at Klein Point. If lifting the Coastal Reserve is recommended, a recommendation will be made to the Governor to vary the SA Coastal Reserve Proclamation.
