About the application
HP Resources SA Pty Ltd made an application on 6 December 2022 for a mining lease over mineral claim (MC) number 4541 for the recovery of extractive minerals pursuant to Section 35 of the Mining Act 1971 (the ‘Act’).
The mining lease is located approximately 15 km northeast of Strathalbyn.
Statutory circulation of the mining proposal
Under Section 56H(3) of the Act, the Minister must invite members of the public to make written submissions in relation to the application for a mining lease, and to have due consideration of the public submission when assessing the mining application.
The mining proposal was made available to the public with an invitation for comment from 26 July 2023 to 24 August 2023.
During this time, 11 public submissions were received by the Department for Energy and Mining (DEM).

Under Section 566H(4) of the Act, copies of all submissions received were forwarded to the proponent with a request to respond on matters raised in the submissions which was issued to applicant on 27 November 2023.
The request for response also included a consolidated list of matters raised by relevant South Australian Government departments (including comments from DEM).
Proponent’s response to public submissions was submitted to DEM on 24 April 2024.
The decision
Under Section 56H(6), the Minister must have regard to any submissions or response received in determining whether or not to grant an application and, if so, the terms and conditions on which it should be granted.
A decision to grant an application for a mining lease (ML 6563) was made on 4 August 2025, with conditions attached to the approval, to address concerns that have been raised in the submissions.
Current status of the operation
Assessment and approval of a program for environment protection and rehabilitation (PEPR) will be required to allow operations to commence.
The PEPR once approved will be published on the DEM website.
