Have your say on regulations for Energy Resources Act

The Petroleum and Geothermal (Energy Resources) Amendment Act 2023, which amends the Petroleum and Geothermal Act 2000, passed the South Australian parliament in November 2023.

The amended Act will become operational once the associated regulations are established.

    To maintain leading  practice regulation of the petroleum, gas storage, pipeline transmission and geothermal energy industries in South Australia the department is updating current regulations.

    The proposed amendments have been developed based on extensive feedback received from industry and co-regulators.

Next steps

The department will consider your feedback following consultation, and the Petroleum and Geothermal Energy (Energy Resources) Act 2023 amendments, as well as the regulation, will be proclaimed in the coming months.

Amending the Petroleum and Geothermal Energy Act

Proposed amendments to the Petroleum and Geothermal Energy Act 2000 (the PGE Act) were put out for consultation in 2021, with consultation on a final draft Bill in November 2022. The feedback received has informed the proposed regulations.

The bulk of the proposed changes to amend the PGE Act are improvements to efficiency, clarity and transparency of existing regulatory processes.

Notably hydrogen generation provisions which were included in the 2021 draft Bill have been removed - these provisions are now proposed for inclusion in the South Australian Government's separate legislation to licence and regulate hydrogen energy (the Hydrogen and Renewable Energy Act 2023).
